Terms of Service

These terms are an agreement between you and Berlayar A.I. (“Berlayar”, “we”, “our”) governing your use of our products, including the canvas-native creative tool aether and our publishing integrations with social platforms (collectively, the “Service”). By using the Service you agree to these terms. If you do not agree, do not use the Service. Questions: hello@ernie.sg.

1. Eligibility & account

You must be at least 18 years old (or the age of majority where you live) to use the Service. You are responsible for keeping your account credentials secure and for all activity under your account. Notify us promptly of any unauthorized use.

2. Your content

You retain all rights to the content you bring to or create within the Service — references, prompts, generated assets, and the schedules you build. You grant Berlayar a limited, non-exclusive license to host, process, and transmit your content solely to operate the Service for you and to publish it to the platforms you connect, on the schedule you set. We do not use your content to train models that benefit other customers, and we do not sell or syndicate it.

3. Acceptable use

You agree not to use the Service to:

  • violate any law or the rights of others, including intellectual property and privacy;
  • generate, schedule, or publish sexual content involving minors, content that incites violence, or content that targets a person or group with hateful conduct;
  • impersonate any individual or organization, or misrepresent your affiliation;
  • build databases of biometric or other sensitive personal data without lawful basis;
  • circumvent any rate-limit, security, or access control;
  • resell, sublicense, or operate the Service as a service to third parties without our written consent.

We may suspend or terminate accounts that violate these rules. Each connected platform also has its own terms — your activity on that platform is bound by those rules in addition to these.

4. AI-generated content

The Service uses third-party AI models (e.g. Anthropic, OpenAI, Google, Replicate, Volcengine Ark). Output may contain inaccuracies and may not be unique to you. You are responsible for reviewing any output before publishing it and for complying with applicable disclosure laws — including marking AI-generated media as such where the platform or jurisdiction requires it.

5. Connected platforms

When you connect a social platform (Pinterest, X, Instagram, Facebook, TikTok, LinkedIn, YouTube), you authorize Berlayar to act on your account only as you instruct — typically to publish posts you author, on the schedule you set, and to read back post status. Each platform’s own Terms of Service and developer agreement continue to apply to your use of that platform. You may disconnect any platform from inside the Service at any time, which revokes our access on a going-forward basis.

6. Beta & availability

Parts of the Service are provided as a beta or sandbox and may change, break, or disappear without notice. We do not guarantee uptime, retention beyond what is stated in our Privacy Policy, or that any specific feature will continue to be offered.

7. Pricing

The Service may be free during early access. Once paid plans are introduced, we will give existing users notice and an opportunity to choose a plan or close the account before any charge. Taxes are your responsibility unless we are required by law to collect them.

8. Termination

You may stop using the Service at any time. We may suspend or terminate access if you breach these terms, if continued operation creates a security or legal risk, or if we discontinue the Service. On termination, your access ends; export your content before then. We will delete your data on request per our Privacy Policy.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE MAXIMUM EXTENT PERMITTED BY LAW, BERLAYAR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BERLAYAR’S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (i) THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (ii) USD 100. WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA, EVEN IF ADVISED OF THE POSSIBILITY.

11. Indemnity

You agree to indemnify and hold Berlayar harmless from claims arising out of content you submit or publish through the Service and any breach of these terms by you, except to the extent caused by our negligence or willful misconduct.

12. Governing law

These terms are governed by the laws of Singapore. Any dispute will be brought exclusively in the courts of Singapore, except that either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property or confidential information.

13. Changes

We may update these terms from time to time. We will revise the “last updated” date above and, for material changes, give notice by email to active accounts. Continued use after a change means you accept the updated terms.
